Notice of the Ministry of Commerce on Launching E-commerce Demonstration Work

In order to implement the "Opinions of the General Office of the State Council on Reinvigorating Circulation and Expand Consumption" (Guobanfa [2008] No. 134) and "Ministry of Commerce's Opinions on Accelerating E-Commerce Development in the Circulation Field" (Commercial and Trade Corporation [2009] No. 540) and The guidelines of the Ministry of Commerce on Promoting the Healthy Development of Online Shopping (Trade name CM [2010] No. 239) and other documents strengthen the promotion and application of modern circulation methods such as e-commerce and new circulation models, and promote e-commerce standards through demonstrations. For healthy development, the Ministry of Commerce has decided to launch e-commerce demonstration work nationwide. The relevant matters are hereby notified as follows:

I. Significant significance Accelerating the development of e-commerce, promoting the modernization of circulation through informatization, helping to improve the consumer environment, broadening the consumption channels, expanding the scale of consumption, promoting social employment, and adjusting the economic structure is to increase the efficiency of commodity circulation, reduce circulation costs, and benefit people's livelihood The inevitable requirements for changing the mode of economic development. At present, the development of e-commerce in China is still in its infancy. The overall level of application of the industry is low, and there is a wide gap between different regions. The supporting systems such as credit, payment, logistics, and taxation are not yet perfect. E-commerce demonstration work is carried out to make use of typical enterprises. The role of demonstration and guidance is conducive to promoting the sustainable and healthy development of electronic commerce.

2. Work objectives We will strive to use 3-5 years to nurture 50-70 online shopping platforms, industry e-commerce platforms, and e-commerce application demonstration backbone enterprises to bring into play innovative business models, reduce business costs, integrate business resources, and expand markets. It stimulates consumption, improves the industrial chain, and stimulates entrepreneurial employment. It leads the business model innovation, product innovation, standard formulation and price formation, and promotes the coordinated development of upstream and downstream affiliates, making full use of two markets and two resources. Change the mode of development, speed up the pace of economic restructuring, and achieve a sound and rapid economic and social development.

III. Main Tasks (1) Establishing demonstration enterprises Fully mobilize the enthusiasm of local commerce authorities, intermediary organizations, experts, and enterprises, and participate in the establishment of e-commerce model enterprises to form a joint effort. After the selection and determination of e-commerce model enterprises, the Ministry of Commerce issued a document. Dynamic management, follow-up evaluation of model enterprises, and timely elimination of model standards that are no longer met.

(II) Strengthen guidance and demonstrations Strengthen the propaganda of e-commerce model enterprises, give full play to its exemplary role in nurturing new models and exploring new fields, promote and apply good experiences and good practices in e-commerce to open up markets and increase profits, and promote enterprises Strengthen e-commerce applications, enhance e-commerce model, technology and service innovation capabilities, and expand e-commerce applications and market size.

(III) Optimizing the development environment by taking demonstration work as a breakthrough point, exploring and improving e-commerce laws and regulations and standards systems, improving support systems, researching and formulating e-commerce application promotion and support policies, and encouraging local governments at all levels to launch supporting measures to promote e-commerce development in the region; Based on the demonstration work, a working mechanism for the follow-up assessment and statistical analysis of e-commerce applications was established.

Fourth, the work process (a) reporting procedures 1, local declarations. The provincial commerce department accepts the enterprise's application and recommends it to the Ministry of Commerce. The number of e-commerce model enterprises declared by provincial-level commerce authorities in the eastern region does not exceed 3 in principle, and 1-2 in the central and western regions.

V. III. Model standards 1. 2. 3. The company has opened an independent e-commerce platform for more than 2 years (such as the traditional enterprise e-commerce application platform, opened more than 1 year), the platform is stable and reliable, has obtained the Internet information service value-added telecommunications business license, or has passed the non-operation Internet information service records, obtain ICP certificate number.

4. The company establishes a special organization and management organization for e-commerce applications, formulates development plans for e-commerce applications, has a professional talent team, has sufficient financial guarantees, has a sound management, technology and financial system, and has perfect pre-sales and sales. 5. The production and operation status of the enterprise is good. In the previous year, the main business income and profits and taxes increased steadily. The amount of purchases and sales of the e-commerce application of the enterprise took a leading position in the industry, and its proportion of total purchases and sales increased year by year. 6. The enterprise e-commerce application is innovative, unique, and has strong ability for sustainable development. Enterprises actively carry out mode innovation, technological innovation, and business innovation. They have unique characteristics in business goods, distinctive business methods, and distinctive service forms. 7. The social benefits of the company's e-commerce applications are obvious. 9. The professional online shopping platform for consumers should also have the following conditions:

(3) There are corresponding sound management and prevention and control measures for illegal activities such as pyramid schemes, fraud, sales of contraband, counterfeiting, illegal collection of funds, etc.

10. The professional e-commerce platform for enterprise-to-business transactions should also meet the following conditions:

(1) more than 3,000 corporate members registered on the platform;

(2) E-commerce-related annual service income of more than 20 million yuan;

(3) The total number of employees in the company is more than 100, including more than 50% of the total number of employees engaged in e-commerce services and technical personnel.

(4) Failure to engage in illegal and irregular business activities such as commodity standardization contract transactions, illegal ** and securities transactions, and corresponding sound management and prevention measures.

11, the traditional enterprise e-commerce application platform operating companies should also have the following conditions:

(1) The annual sales of self-built e-commerce platform for enterprise applications are more than 10 million yuan, or the annual purchase amount is more than 50 million yuan;

(2) Enterprises engaged in e-commerce services, technical personnel in more than 10 people;

(3) The ordering and payment process can be completed electronically.

(4) There are sound management and prevention and control measures for illegal activities such as pyramid schemes, fraud, sales of contraband, counterfeiting, illegal collection of funds, etc.

Fourth, the working procedure 1. Declarations are made everywhere. The relevant enterprise fills in the declaration form according to its own situation, and attaches the business license of the industry and commerce, the business approval certificate concerning administrative licensing goods and services, a copy of the tax registration certificate, the audited annual report and other certification materials, and reports to the provincial-level commercial director Departments; provincial-level commerce authorities organize relevant institutions and experts to determine the recommended list after submitting the information submitted by the applying unit, and submit the recommended documents and the application materials (1 original and 7 copies) to the Ministry of Commerce.

2. Expert assessment. The Ministry of Commerce organizes experts in the industry to evaluate the data of the reporting company based on the model establishment criteria, conduct on-the-spot investigations of the relevant contents, propose assessment opinions, and formulate a list of model enterprises.

3. Results publicity. The list of proposed model enterprises shall be publicized on the website of the Ministry of Commerce. Any unit or individual who has different opinions on the list may submit an objection to the Ministry of Commerce.

4. Published the article. If the proposed model enterprise has no objection or objection during the publicity period, the Ministry of Commerce shall determine it as a model enterprise and publish the model enterprise list in the form of a document of the General Office of the Ministry of Commerce.

V. Dynamic Management 1. The e-commerce model enterprises have implemented a business reporting system. Before the end of February each year, the company reported the business situation of the previous year to the Ministry of Commerce and the local provincial competent commerce department for dynamic evaluation.

2. If the identified e-commerce model companies change their name or change their business scope, merger, division, and change of business, they shall promptly file with the Ministry of Commerce and the local provincial competent commerce department.

3. The identified e-commerce model enterprises have one of the following conditions, canceling their demonstration qualifications:

(1) There is false information in the application materials;

(2) Serious default behaviors such as defaulting on bank debts, tax arrears, malicious wage arrears, selling fake and shoddy products, infringing the legitimate rights and interests of consumers, etc.;

(3) Being punished by the law enforcement authorities for illegal or irregular behaviors;

(4) Other circumstances that no longer meet the model standards.

Within 2 years after the company is canceled the demonstration qualification, it is forbidden to apply for the e-commerce demonstration enterprise.

This specification is interpreted by the Ministry of Commerce (Business Services Department).
